TERMS & CONDITIONS, ASSUMPTION OF RISK AND RELEASE OF LIABILITY

By booking, renting, or participating in activities or equipment provided by Serjo Bouncy Castles (“Company”), the customer signing this agreement (“Renter”) acknowledges and agrees to the following terms.

1. ASSUMPTION OF RISK

The Renter understands that the use of inflatable amusement equipment, water slides, interactive games, Foam Party equipment, Laser Tag, Gelly Ball and other recreational equipment or activities involves inherent and unforeseen risks.

These risks may include slipping, falling, jumping, bouncing, running, collisions with other participants or objects, equipment movement or deflation, wet or slippery surfaces, and other risks that may result in injury, illness, property damage, serious injury or, in rare circumstances, death.

The Renter voluntarily accepts and assumes these risks for themselves and acknowledges responsibility for informing and supervising their children, guests and participants.

2. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, the Renter, on behalf of themselves and their heirs, representatives and assigns, releases and discharges Serjo Bouncy Castles, its owners, employees, contractors and representatives from claims, demands, damages, actions or causes of action arising from or connected with participation in the activities or use of the rented equipment, including claims arising from the inherent risks of such activities.

The Renter understands that this agreement is intended to limit and release liability to the fullest extent permitted by the laws of Ontario.

Nothing in this agreement is intended to exclude or limit liability that cannot lawfully be excluded or limited.

3. SUPERVISION AND RESPONSIBILITY

A responsible adult must supervise children and the rented equipment at all times while it is in use.

The Renter is responsible for ensuring that all participants and guests follow the safety rules, posted warnings and instructions provided by Serjo Bouncy Castles.

The Renter agrees not to allow anyone to use the equipment in an unsafe manner and will immediately discontinue use if unsafe conditions arise.

4. GENERAL SAFETY RULES

Participants must follow all instructions and posted capacity and weight limits.

Shoes, jewellery, sharp objects, food, drinks and gum must be removed before entering inflatable equipment.

No flips, wrestling, pushing, rough play, climbing on inflatable walls or other dangerous behaviour is permitted.

Participants of significantly different sizes or ages should be separated when necessary for safe operation.

Pets, Silly String, confetti and sharp objects are prohibited on or around inflatable equipment.

Equipment must not be moved, altered or disconnected without authorization from Serjo Bouncy Castles.

5. WEATHER AND EQUIPMENT SAFETY

Inflatable equipment must not be used during unsafe weather conditions, including strong winds, thunderstorms or lightning.

The Renter agrees to immediately stop use and remove all participants if weather conditions become unsafe or if instructed to do so by Serjo Bouncy Castles.

If an inflatable loses air or begins to deflate, all participants must exit immediately. Use must not resume until the equipment is fully inflated and operating normally.

6. FOAM PARTY

The Renter acknowledges that Foam Party activities create wet and slippery surfaces and may involve risks of slipping, falling, collisions, and temporary skin or eye irritation.

Participants should avoid intentionally ingesting foam or getting foam directly into their eyes. Anyone experiencing irritation or another adverse reaction must stop participating and rinse the affected area with clean water as appropriate.

Participants with known sensitivities or allergies to soaps, detergents, fragrances or similar products should exercise appropriate caution.

Children must be supervised by a responsible adult at all times.

7. LASER TAG

The Renter acknowledges that Laser Tag is an active physical activity involving movement, running and interaction with other participants and may involve risks of slipping, tripping, falling or collision.

Participants must remain within the designated playing area, follow all instructions and avoid physical contact, tackling, pushing, unsafe climbing or other dangerous behaviour.

Laser Tag equipment must be used only for its intended purpose and must not be thrown, struck against objects or used to physically strike another participant.

8. GELLY BALL

The Renter acknowledges that Gelly Ball involves projectiles and may cause temporary discomfort, minor marks or bruising.

Approved eye and/or face protection must be worn at all times during active play and must not be removed while a participant is inside the designated playing area.

Participants must follow all instructions, remain within the designated area and never intentionally shoot persons who are not participating.

Physical fighting, pushing, tackling or intentional misuse of equipment is prohibited.

9. EQUIPMENT DAMAGE

The Renter agrees to exercise reasonable care of all rented equipment.

The Renter may be responsible for repair or replacement costs resulting from intentional damage, misuse, unauthorized movement, prohibited products or failure to follow the Company's instructions, excluding normal wear and tear.

10. DELIVERY, SETUP AND ACCESS

The Renter authorizes Serjo Bouncy Castles and its representatives to enter the property at the delivery location as reasonably necessary to deliver, install, inspect, service and remove rented equipment.

The Renter is responsible for providing safe and reasonable access to the setup location and for identifying known underground or property hazards that could affect installation.

11. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.

I acknowledge and certify that I have had sufficient opportunity to read this entire document, that I understand its content and that I execute it freely, intelligently and without duress of any kind and agree to be bound by its terms.

12. ACKNOWLEDGEMENT AND ELECTRONIC SIGNATURE

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

By electronically signing this agreement, the Renter confirms that they have read and understood these Terms & Conditions, understand and voluntarily accept the risks associated with the rented equipment and activities, and agree to the Release and Waiver of Liability contained in this agreement.

13. Deposit & Cancellation Policy

A 30% non-refundable deposit is required to secure your reservation. Your booking is not confirmed until the deposit has been received.

The deposit is non-refundable in the event of customer cancellation. If you need to reschedule, the deposit may be transferred to another available date within 12 months, subject to availability.

In the event of unsafe weather conditions, including heavy rain, thunderstorms, or strong winds, Serjo Bouncy Castles reserves the right to cancel or reschedule the rental for safety reasons. If Serjo Bouncy Castles cancels the rental due to unsafe weather, the customer may transfer the deposit to another available date or receive a refund of the deposit.

The remaining balance is due on the day of the event.

By paying the deposit, the customer acknowledges and agrees to this Deposit & Cancellation Policy.

The Renter confirms that they are at least 18 years of age and have the legal authority to enter into this agreement.

The Renter agrees that their electronic signature constitutes their acceptance of these Terms & Conditions and is intended to have the same effect as a handwritten signature.
